BAR HARBOR—The Bar Harbor Police Department is starting to get calls about unattended dogs in cars on warmer days. The following is a summary of Maine law about animals left unattended in a vehicle.
7§4019. Removal from unattended motor vehicle
1. Removal authorized
A law enforcement officer, humane agent, animal control officer, firefighter as defined in Title 26, section 2101, first responder as defined in Title 32, section 83, subsection 13-A or security guard licensed under Title 32, chapter 93, referred to in this section as “authorized persons,” may take all steps that are reasonably necessary to remove an animal from a motor vehicle if the animal’s safety, health or well-being appears to be in immediate danger from heat, cold or lack of adequate ventilation and the conditions could reasonably be expected to cause extreme suffering or death.2. Notice required
A law enforcement officer, humane agent or animal control officer who removes an animal in accordance with subsection 1 shall, in a secure and conspicuous location on or within the motor vehicle, leave written notice bearing the officer’s or agent’s name and office and the address of the location where the animal may be claimed. A firefighter, first responder or security guard who removes an animal in accordance with subsection 1 shall, in a secure and conspicuous location on or within the motor vehicle, leave written notice bearing the person’s name and the address of the location where the animal may be claimed. The owner may claim the animal only after payment of all charges that have accrued for the maintenance, care, medical treatment and impoundment of the animal.3. Immunity
An authorized person who removes an animal from a motor vehicle pursuant to subsection 1 is immune from criminal or civil liability that might otherwise result from the removal.
The following incidents occurred in Bar Harbor last week according to the Bar Harbor police log, which is publicly released information.

A subject made a suspicious vehicle complaint, but officers were unable to locate the vehicle.
Officer Troy Stanwood issued a trespass warning to an individual who was camping in an area where camping is not allowed.
Officer Stanwood received a noise complaint concerning noise due to construction.
Officer Judson Cake handled a theft of services complaint that was ultimately determined to be a civil issue and was resolved between the two parties.
Officer Stanwood took a report of suspicious activity.
Officer Elias Burne assisted a citizen.
An individual turned over a credit card that they had found to the police department.

Officer Amie Torrey located a business with an open door after business hours and checked the building.
Officer Stanwood responded to a medical call.
Officer Cake helped get a found bicycle retuned to its owner.
Robert Chaplin, 84, of Bar Harbor, was driving east on the Crooked Road in a 2022 Kia Sportage when a deer jumped in front of his vehicle. The vehicle suffered disabling damage to the front and no injuries were reported.
Carter Edwards, 59, of Auburn was driving a 2010 Honda Accord and making a turn at the intersection of Cottage Street and Eden Street. While making the turn, Edwards’ vehicle allegedly struck a bicycle being ridden by Abby Paquette, 21, of Easthampton, MA. Paquette was transported to the hospital with non-life-threatening injuries. The bicycle was a total loss and the vehicle suffered front passenger side and windshield damage.
The police department received a motor vehicle complaint on Route 102. No officers were in position to find the vehicle and the call was passed on to the Southwest Harbor Police Department who later located the vehicle and issued the operator a warning for their driving.
Officer Jerrod Hardy responded to a request to help capture a loose dog, but before he could arrive, the dog had been captured by its owner.
Officer Chris Dickens spoke with an individual regarding a trespassing issue.
A found wallet was turned in to the police department and the owner came and retrieved it later.
Wednesday, May 10, 2023
Officers responded with the fire department to a medical call at a residence.
Officer Cake spoke with some individuals who were raising awareness for Restoration Homes Recovery program and advised them to stay out of the roadway.
Officer Stanwood responded to a motor vehicle complaint, located and stopped the vehicle, and checked for impairment. No signs of impairment were found.
An officer responded to Seabury Drive for a suspicious vehicle complaint.

Officer Caleb Mora took a report from a customer about a business and determined that the complaint was not a law enforcement issue.
Lost property was turned in to the police department.
Officer Stanwood warned an individual for consuming alcohol in public.
Officer Tim Bland responded to a complaint of a dog being left in a vehicle.
Officer Stanwood provided a service for a local business.
Cynthia Buzzini, 57, of Hampden was starting to turn from Ledgelawn Avenue onto Mount Desert Street in a 2016 Volvo V60 when an oncoming vehicle caused her to stop. James Pinkham, 68, of Bar Harbor, was behind Buzzini in a 2016 Ford F-150 and started to move forward as Buzzini did. When Buzzini stopped suddenly, Pinkham could not stop fast enough and his vehicle struck the rear of Buzzini’s vehicle. There was minor damage to the Volvo, no damage to the Ford, and possible minor injury.
Officer Hardy fingerprinted an individual for a visa application.
Officer Burne went to the MDI Hospital to assist another agency.
A found credit card was turned in to the police department.
Another found credit card was turned in to the police department. The owner was contacted and retrieved the card.
Officer Burne responded to a motor vehicle complaint but was unable to locate the vehicle.
A third found credit card was turned in to the police department.
Officer Hardy gave an individual a ride home from the hospital.
Officers responded to a report of a domestic dispute and as a result of the investigation, Joseph Sisler, 40, of Colorado, was arrested for alleged domestic violence assault and transported to the Hancock County Jail.

An individual reported having lost their wallet.
Officer Hardy conducted a well-being check and found the subject to be all set.
Officer Burne responded to a complaint of a dog being left in a car unattended.
Officer Ted Cake spoke to a person who had some mental health questions.
Officers attempted to locate a person with an active arrest warrant but were unsuccessful.
Officer Stanwood responded to a motor vehicle complaint on Route 3 but was unable to locate the vehicle.
Officer T. Cake responded to a motor vehicle complaint but was unable to locate the vehicle.
Officer Burne issued a no trespass warning to an individual for a local business.
A 2022 Subaru Outback, last operated by Emily Pepper, 33, of Maine, was parked on Main Street when it was struck by a Nissan Altima. The driver of the Altima did not stop at the scene and the operator is unknown. The Subaru suffered minor damage. The Altima was caught on a surveillance camera and the incident is under investigation.
The police department took a motor vehicle complaint but officers were unable to locate the vehicle.
Officers performed a compliance check at a bar and found no issues.

After conducting a motor vehicle stop, Justin Moore, 33, of North Carolina was summonsed for alleged driving to endanger by Officer Mora.
Pursuant to a motor vehicle stop by Officer Kaleb Payson, Bailey Stillman, 27, of Bar Harbor, was arrested for alleged operating under the influence and was transported to the Hancock County Jail.
Following a traffic stop, Aaron Boucher, 28, of Mount Desert, was arrested, by Officer Mora, for allegedly violating conditions of release and was transported to the Hancock County Jail.
Officer J. Cake responded to a parking complaint and found that the subject vehicle was parked legally.
Officer J. Cake participated at the YMCA Healthy Kids Day.
Officer T. Cake warned a subject for harassment.
Officer T. Cake received some information from an individual.
A concerned family member called the police department and stated that their brother’s vehicle was parked on the Eagle Lake Road, but they did not know where their brother was. They called back a short time later and reported that their brother had returned home safely.
Officer Stanwood provided a police detail for the MDI High School prom.
An officer stopped to investigate a vehicle parked in a dangerous location on the Eagle Lake Road. They found the occupants to be looking at the stars and asked them to move to a safer location.

Officer J. Cake summonsed Joseph Chalmers, 18, of Southwest Harbor, for criminal speed.
Officer J. Cake spoke with an individual who had a social media account hacked.
Officer Burne helped someone jumpstart their vehicle.
Officer Payson conducted a traffic stop and as a result, Austin Korgan, 34, of Lamoine, was arrested for alleged operating under the influence and was transported to the Hancock County Jail.
